About POSH Act (2013)
The Prevention of Sexual Harassment (POSH) Act, 2013 aims to provide protection against sexual harassment of women at the workplace and to ensure a safe, secure, and dignified working and learning environment for all. This policy applies to faculty, staff, students, interns, visitors, and any person associated with the institution.
Definition of Sexual Harassment
"Sexual Harassment" includes anyone or more of the following unwelcome acts or behaviour (whether directly or by implication), namely:
1. Physical contact or advances;
2. A demand or request for sexual favours;
3. Making sexually coloured remarks;
4. Showing pornography;
5. Any other unwelcome physical, verbal or non-verbal conduct of a sexual nature

Procedure for Filing Complaint
-
A written complaint should be submitted within 3 months of the incident.
-
Complaint may be submitted to the Presiding Officer or via official ICC email(ic.gec@gec.ac.in).
-
Assistance will be provided to the complainant in filing the complaint if required.
-
Conciliation may be initiated upon request, excluding monetary settlement.
Inquiry Process
-
Notice will be issued to the respondent.
-
Both parties will be given fair opportunity to be heard.
-
Inquiry will be completed within 90 days.
-
Report will be submitted within 10 days of completion.
-
Action to be taken within 60 days.

Possible Actions / Penalties
Where the Internal Committee arrives at the conclusion that the allegation against the respondent has been proved, it shall recommend to the employer to take action for sexual harassment as a misconduct in accordance with the provisions of the service rules applicable to the respondent or where no such service rules have been made, in such manner as may be prescribed;
Possible actions may include:
For Employees:

Fine upto Rs. 1,00,000 or imprisonment for upto three years, or both;

Disciplinary action, including a written apology, reprimand, warning, censure;

Withholding promotion/pay rise/increment;
-
Suspension or termination;
-
Counseling;
-
Community service;
-
Police complaint in severe cases
For Students:

Warning
-
Suspension

Rustication
-
Expulsion
Duties of the Institution (Section 19)
The institution must:

Provide a safe working and academic environment
-
Display penal consequences of sexual harassment
-
Organize awareness and sensitization programmes
-
Provide assistance in filing police complaints (if required)

Ensure confidentiality
-
Act upon IC recommendations
-
Treat sexual harassment as misconduct under service rules
